WEAPONS IN THE
SCHOOLS Weapons and replicas of
weapons as defined in Oregon law are forbidden on school property including
parking areas, except for those in possession of law enforcement officers
and/or individuals who are licensed or otherwise authorized to carry loaded or
unloaded firearms. Those people so authorized must report their
possession of such firearms upon entering any school building or facility.
Reports shall be made to the building principal or other school official in
charge of the building or facility. Oregon Law
Weapons shall
include, but not be limited to, firearms, knives, metal knuckles, straight
razors, explosives, noxious, irritation or poisonous gases, poisons, drugs or
other items fashioned with the intent to use, sell, harm, threaten or harass
students, staff members, parents and patrons.
Under Oregon law,
"dangerous weapon" means any weapon, device, instrument, material or substance
which under the circumstances in which it is used, attempted to be used or
threatened to be used is readily capable of causing death or serious physical
injury.
Any loaded or unloaded firearm or dangerous weapon possessed on
or about a person while on District property including parking areas may be
subject to seizure or forfeiture.
Incidents of students possessing
weapons will be reported to each student's parents and may be reported to the
police.
Under Oregon law, students bringing a weapon to school will be
expelled for a period of not less than one year. The superintendent may, on a
case-by-case basis, modify this expulsion requirement. The District may request
suspension of driving privileges from a student expelled for bringing weapons
to school.
Weapons under the control of law enforcement personnel are
permitted. The superintendent may authorize other persons to possess weapons in
school buildings. The superintendent may prescribe special conditions or
procedures to be followed before giving such authorization.
Federal
Law
Under federal law, students bringing a weapon to school including
parking areas shall be expelled for a period not less than one year. However,
on a case-by-case basis, the superintendent may determine an expulsion for less
than one year is appropriate.
Under federal law, "weapon" is defined as
any weapon which will or is designed to or may readily be converted to expel a
projectile by action of an explosive, the frame or receiver of any such weapon,
any firearm muffler or firearm silencer or destructive device. "Destructive
device" means any explosive, incendiary or poison gas, bomb, grenade, rocket or
missile.
The District shall maintain a record of the number of
expulsions for weapons and the types of weapons concerned.
